Anti-Spam Policy
Last updated: September 22, 2026
Atellier provides tools that allow our customers ("Senders") to send email and SMS to recipients they have a relationship with. This policy explains your obligations as a Sender and our enforcement approach. It is part of the Acceptable Use Policy and the Terms of Service.
You Are the Sender
When you send a message through Atellier, you — not Atellier — are the sender, the controller of the recipient list, and the party legally responsible for the message. You will defend and indemnify Atellier against any claim arising from messages you send.
Applicable Laws
- CAN-SPAM Act (US) — accurate headers, accurate subject lines, valid physical address, working unsubscribe link, opt-outs honored within 10 business days (we honor within 24 hours).
- TCPA (US, SMS & voice) — express written consent for marketing SMS to mobile numbers; documented opt-in records.
- 10DLC (US carriers) — registered brand and campaign with The Campaign Registry; throughput and content rules per carrier.
- CASL (Canada) — express or implied consent; clear identification; functional unsubscribe within 10 business days.
- GDPR / ePrivacy (EU/UK) — lawful basis for marketing (typically consent); easy withdrawal.
- Local laws in any jurisdiction where your recipients reside.
Opt-In Requirements
- You must have prior express consent or a qualifying existing business relationship for every recipient on every channel.
- You must keep auditable records of opt-ins (timestamp, source, IP, the language shown to the recipient) and produce them on request.
- You may not use purchased, rented, scraped, or appended lists.
- Consent obtained for one purpose (e.g., a transactional update) is not consent for another (e.g., promotional marketing).
Opt-Out Handling
Atellier honors opt-outs at the platform level:
- Email. Every marketing email sent through Atellier includes an unsubscribe link and a one-click unsubscribe header. When a recipient uses either, they are added to the suppression list and excluded from future marketing sends. Replying "STOP" or "UNSUBSCRIBE" to an email is not processed automatically — if you receive such a reply, you must unsubscribe that recipient yourself.
- SMS. Replies of STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPT OUT are honored automatically and the number is suppressed from future messages from your organization; replying START opts the number back in. You must also honor any other reasonable request to stop that a recipient sends you.
You may not attempt to circumvent suppression lists, and you may not re-import a suppressed contact without fresh, documented opt-in.
Message Requirements
- Accurate "From" name and reply-to address identifying the Sender;
- Subject lines that accurately reflect message content (no deceptive baiting);
- A valid physical postal address of the Sender in every marketing email — Atellier adds your organization's postal address to each marketing email, so keep it accurate in your settings;
- Clear identification of promotional content as advertising;
- A working unsubscribe mechanism in every marketing email (Atellier adds an unsubscribe link and one-click unsubscribe header automatically — do not remove or obscure it);
- For SMS marketing: brand identification, message frequency, "Reply STOP to opt out", and (where required) "Msg & data rates may apply".
Prohibited
- Sending to purchased, rented, harvested, or scraped lists;
- Deceptive subject lines or misleading headers;
- Phishing, malware, or fraudulent communications;
- Bulk unsolicited SMS (UCE/UBE);
- Messages to numbers on the U.S. National Do Not Call Registry without an established business relationship or express invitation;
- Any of the prohibited content categories in the AUP (e.g., illegal goods, regulated industries we do not support, deceptive financial offers).
Enforcement
We monitor complaint rates, bounces, and carrier filtering signals. When thresholds are exceeded or violations are reported, we may throttle, suspend sending, or terminate the account per the AUP enforcement ladder. Repeated or serious violations result in immediate termination without refund. We cooperate with ISPs, carriers, and anti-spam organizations.
Reporting Abuse
If you believe you received an unsolicited message sent through Atellier, report it to hello@meonneon.com with the subject "Spam Report." Include the full message headers and we will investigate promptly.
